David Guinn got a not guilty on an African-American gentleman in SWISHER County (Yes, that Swisher County) on a mistake of fact defense. Charge was Felon in possession of a firearm. Client was a felon and he did possess a firearm but testified he just picked it up and put it in his pocket without realizing what it was. (apparently it was an unusual gun that did fold up). 70 minute not guilty.

Congratulations to Danny Hurley. His client walked with a grand jury no-bill Tuesday on a murder accusation. Danny used Amarillo polygrapher Jimmy Stevens with great success in the case.

In 140th District Court, Danny Hurley’s client walked out of the courthouse after a three-day trial, beating a second-degree felony accusation of burglary of a habitation with intent to commit aggravated assault. After about three hours of deliberations, the jury found Danny’s client guilty of the lesser-included offense of misdemeanor criminal trespass, and he was sentenced to a one-year probation.

Congratulations to Danny for getting the two-word verdict in a sexual assault case in Midland County. The citizen accused was the former Midland Lee girls basketball coach and the complainant a former player. Apparently, the “avuncular” Mr. Hurley and co-counsel Brian Carney of Midland were able to convince the jury that the complainants history of cheating on tests and lying to her high school and college coaches undermined her credibility in this situation as well.

Congratulations to David Guinn on a big win May 31! Albeit a civil matter, David’s case involves defending the Bill of Rights, of course (1st Amendment). In Charles Ault v. Lubbock County, David got Judge Cummings to grant a preliminary injunction so the Boom Boom Cabaret can continue its sexually oriented business while Lubbock County gets its act together. Fine job, David.

Congratulations to David Guinn. He won a victory in CCL#2 Tuesday on a DWI “B”. It was a “goofy, goofy Tech kid”, per David, who was stopped for running a red light. No breath test. The jury was out 15 minutes.

Also this week, in a Garza County murder trial, Danny Hurley was granted a mistrial after complaining that the prosecutor withheld Brady material.

Congratulations on a great appellate victory for Aaron Clements, David Guinn and Danny Hurley. The 7th Court of Appeals issued its opinion in the very high profile Callie Long intoxicated manslaughter case April 10, reversing and remanding for new trial for the trial court’s failure to instruct on the lesser-included offense of driving while intoxicated. Danny tried it, Aaron briefed it, and David and Aaron argued it.

David Guinn secured a Not Guilty verdict in CCL#2 in a DWI 1st trial. ADA Barron Slack did an outstanding job and is serious force to be reckoned with. Guinn’s client had good balance for a short, heavy guy who refused a breath test but did request a blood test. LPD declined, of course.

Congratulations to Danny Hurley. Client charged with capital murder (with death waived). Received verdict on lesser-included murder, with sudden passion, resulting in an eight-year prison sentence. Danny was assisted by former LCDLA student member Melissa Morgan, now a baby criminal defense lawyer in Aspermont. Congratulations to Danny and Melissa.
